Supreme Court Reinstated Former Congress Government In Arunachal Pradesh

The Supreme Court in its landmark judgment has reinstated former government of Congress chief minister Nabam Tuki and quashed the order of the Arunachal Pradesh governor Jyoti Prasad Rajkhowa to advance the session of the state assembly by a month. The Court said the decision is violative of the Constitution and is liable to be dismissed.

The Court, by directing status quo ante in Arunachal Pradesh has ordered that all the decisions taken by the assembly after the governor’s decision on December 9, 2015 are unsustainable and deserve to be quashed.

The judgment has proved as a shock to the BJP government in the center and paved the way for restoration of Congress government in Arunachal Pradesh.

Earlier, after the governor’s decision to prepone the assembly session, the new speaker had been elected and 21 MLAs from the Congress party, which was in majority in the 60-seat assembly rebelled and Kalikho Pul has been appointed as the ninth chief minister of the Arunachal Pradehsh. 11 BJP MLAs supported the government from outside. Later all the 21 Congress MLAs were disqualified.

This is the first verdict by the Supreme Court to reinstate the former government in the state even after a new government has been elected.

Congress leader Kapil Sibal, who argued the case in the Supreme Court said, “I salute the Supreme Court for this verdict”
