High Court Stays Jat Reservation in Haryana

The Punjab and Haryana High Court today stayed the reservation for Jats and fiver other communities in Haryana provided by the Haryana government under a newsly formed Backward Classes (C) category.

The court was hearing a petition challenging the constitutional validity of the Haryana Backward Classes (Reservations in services and admission in educational institutions) Act 2016 passed by the state assembly unanimously on March 29.

Murali Lal Bhiwani, who was challenging the decision in the High Court and seeking to dismantle block ‘C’ of the act, which provides reservation to the Jat community under newly created backward classes (C) category. Bhiwani submitted that the reservation to Jat community is given on the basis of KC Gupta commission report, which already been dismantled by the Supreme Court.

The petitioner through the counsel submitted that the decision on the basis of KC Gupta commission is against the order already passed by the judiciary and the legislature cannon decide such matters. According to the counsel, only judiciary has the power to revise the findings on an issue already decided by the judiciary.

While passing a judgment in Ram sing and others versus the Union of India case, supreme court had judged the Jats were not backward socially, educationally and politically, when the state government tried to add Jat community in the backward classes category in 2014. This whole issue is submitted in the petition.

The newly carved Backward Classes (C) category, created to give 10% reservation to Jats and other five communities in government services and admission in educational institutions under a new law passed by the Haryana government. The other five communities are jat Sikhs, Muslim Jats, Bishnois, Rors and Tyagis.
